Australia is a democracy, but our Constitution does not protect freedom of speech.
This amendment would change that.
What this amendment would do
- Protect every Australian’s right to speak, express opinions, and share information without fear of government punishment
- Protect whistleblowers who expose corruption, abuse of power, or serious wrongdoing
- Prevent governments from silencing criticism, debate, or dissent
- Give courts the power to stop unjustified censorship
What this amendment would NOT protect
- Speech that calls for violence, serious harm, or suffering
- True threats or incitement to crime
- Criminal acts disguised as “speech”
Why this matters
Rights that are not written down can be taken away.
An explicit constitutional protection ensures free speech survives political pressure, emergencies, and changing governments.
This amendment balances freedom with responsibility — protecting open debate while drawing a clear line at violence.
